Booking Terms and Conditions
These terms and conditions govern the booking of photoshoot services offered by iStar Photography through our website. By booking a photoshoot with us, you agree to these terms and conditions in full. Please read them carefully.
1. Booking and Payment
1.1 Booking: The booking is confirmed only upon receipt of a non-refundable booking fee, which will be specified at the time of booking.
1.2 Payment: The full balance for the photoshoot is due on the day of the shoot unless otherwise agreed upon in writing. We accept payment via Bank Transfer/EFT, details of which will be provided upon booking confirmation.
2. Rescheduling and Cancellations
2.1 Rescheduling by Client: You may reschedule your photoshoot without penalty up to 5-7 days before the scheduled date, subject to our availability. A rescheduling fee may apply if rescheduled within 1-4 days of the shoot.
2.2 Cancellation by Client: If you cancel the photoshoot, the booking fee is non-refundable. Depending on the notice period and circumstances of cancellation, additional cancellation fees may apply.
2.3 Cancellation by Photographer: In the unlikely event that we need to cancel your photoshoot due to unforeseen circumstances (e.g., illness, equipment failure), we will offer you the option to reschedule at no additional cost or provide a full refund of any payments made.
3. Client Cooperation
3.1 Cooperation: You agree to cooperate with us and follow our instructions to achieve the best possible photographic results. This includes but is not limited to being punctual, providing necessary information, and adhering to agreed-upon schedules and locations.
4. Image Delivery and Usage
4.1 Delivery: We will deliver the final edited images within 5-7 working days after the photoshoot date, unless otherwise agreed upon. Delivery will be via Client Gallery or WeTransfer.
4.2 Usage Rights: Unless otherwise agreed in writing, we retain copyright to all images and reserve the right to use them for promotional purposes, including but not limited to our website, social media, and marketing materials. You are granted personal usage rights for non-commercial purposes only.
5. Liability
5.1 Limitation of Liability: While we take utmost care in capturing and delivering images, we are not liable for any loss or damage caused directly or indirectly during the photoshoot, including but not limited to equipment failure, accidents, or acts of nature.
5.2 Client Responsibility: You are responsible for your own safety and that of any individuals participating in the photoshoot. We are not liable for any injury, loss, or damage incurred during the photoshoot.
6. Complaints
6.1 Complaints: If you have any complaints about our services, please notify us as soon as possible and we will endeavor to resolve the issue promptly and fairly.
7. Governing Law
7.1 Governing Law: These terms and conditions are governed by the laws of South Africa. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in South Africa.
8. Late arrivals
8.1 Late arrivals: These terms and conditions apply to all clients booking photography services. By booking and attending a photography session, you agree to the following terms regarding late arrivals:
8.2 Punctuality: Clients are expected to arrive at the scheduled time for their photography session. Timeliness is essential to ensure the best possible results and maximize the session duration.
8.3 Late Arrival: The session may be shortened due to the delay, without a reduction in the session fee.
The photographer reserves the right to cancel the session if the delay significantly impacts other scheduled sessions. In such cases, no refunds will be issued.
8.4 Communication: If you anticipate being late, please inform the photographer as soon as possible. The photographer may, at their discretion, adjust the session time if the schedule allows, but this cannot be guaranteed.
8.5 No Shows: If you fail to show up within 30 minutes of the scheduled time without prior notice, the session will be considered a no-show, and the full session fee will be charged. No refunds or rescheduling will be offered.
8.6 Photographer’s Discretion: The photographer reserves the right to make exceptions to these terms under exceptional circumstances, such as emergencies or unforeseen events, at their sole discretion.
8.7 Refunds: No refunds will be given for time lost due to late arrivals. If the photographer is late, the session time will be extended accordingly or rescheduled without additional charges.
8.8 Agreement to Terms: By booking a session, you acknowledge that you have read, understood, and agreed to these terms and conditions regarding late arrivals.
